First off Child support in WV is the ability to hold a toddler on a hip. Two, why the sudden need for money? Why didn't you put his name on the birth certificate? Why didn't you sue for child support earlier?
Yes you can get back child support, but that is not a definate. Recently a woman in Alabama tried the same thing. The judge ordered her to pay for the DNA testing, whether it came out positive or not. She did and it was his child. Then the judge ordered him to pay for two-hundred dollars a month for the last six years and she was ordered to pay him one-hundred and ninety-nine dollars a month for the last six years because she had denied the Father the right to see his child, plus she got thirty days in jail, during which the Father was to maintain custody of their son. Unfortunately, society has been catching up on the momma/baby/child support scam the last few years and some states have instituted "Chastity belt laws" for every child born. So the baby is genetically linked to the Father in the first couple of weeks. Because a random sampling disproved 22% of Fathers as the biological producer of the claimed child.

Yes. Child support is for the benefit of the child and you can get child support for the past 8 years. Get a lawyer on this if you can or go to the child support enforcement office of W.Va. Usually the state child support enforcement office gets the job done--they're just slower than a private atty, but they're free. Past due child support cannot be forgiven. You can take his property, garnish his wages, get his tax returns. Also, child support and visitation are not tied togeather. The fact that he never visited doesn't matter a bit.

No. In most states he is not liable until a court finds that he is the father. You should visit Social Services and file a claim for child support. The clock won't start ticking until you file the claim.

No thanks to offer up the toddler help. The taxpayers of WV are paying to feed your toddler and substances her remedy. someone has to pay for that. because you're the childs father,it is your duty. it would want to value you a techniques more effective the $three hundred a month in case you had to pay for the formula and medical coverage your self. in case you pick the toddler help funds to offer up,then have your GF supply up her WIC and medical card. He isn't on the birth cert. then you have to prove he is the Father. At the moment, your child has no Father according to the law! It will require a DNA test, and you going to court to prove paternity and ask for support!

i'd say you have a good chance of getting back support, unless he denys knowing about the child (which is sometimes done).
it doesnt matter if his name is on the birth cert or not, for testing (DNA) will more then likely be ordered.
but every state is different (slightly) about CS guidelines. so check these links to find out for sure. one is a cs calculator; just find your state, fill it in and it comes up with an amount that would be paid to you for child support (it goes on both parents incomes). its to get a general idea.

keep in mind that you can not deny visitation to the father, once he has been established as the father. it doesnt matter how much money he owes or if hes late with it. the courts get very angry about that and punish those whom deny parents visitation.
if ever you need an attorney, for what ever issue, contact your local Legal Aid Office. every state has them and are in most counties. they go on a sliding scale and are free to most. just look in your phone book or call the county court clerks office for it. if still no luck, call your state Bar Assoc for it. 304-558-2456

mainly depends on whether you actually filed for child support .......
if you did & a valid court order for child support was issued .......
then he would have a financial obligation to his biological son

Well yeah, if hes the sperm doner then he should. Thats just my opinion though, I dont know the Social Systems laws over there.
