Well that first guy is a dumb ***. the Due process comes from section one of the 14th amendment, and our rights in criminal and civil cases come from the 4th, 5th, 6th, and 7th amendments to the constitution.

First two in the Bill of Rights and the third is the basis of the whole constitution.

It is what the founding fathers believed in when they wrote the constitution. Most likely they got there ideals from there state constitututions.
