It isn't his employers fault he was arrested. Yes its legal for them to terminate him. If he missed work, they need people at this place of business that will be there everyday, not in jail. Sorry everyone needs to be accountable for their actions

Generally, I would say that there is nothing illegal about firing an employee who has been arrested for some alleged wrongdoing, unless the specific state protects the employee by statute or if the employee has a contract with the employer that prevents his termination for such conduct.

Yes. Even in non-at will states, getting arrested on the job for a crime is usually a firing offense.
And the seriousness of the crime matters too.

unfortunately it's legal, there's no law stating that you must keep your job under any circumstances. We have a client that came in and wanted to sue her employeer because the terminated her after 18yrs. because the "new girl" didn't like her. Behind 18yrs. i'd want to sue too but unfortunately she couldn't, however she did have a case because she was emotionaly tormented /dampseled in distress when they demoted her from her manager's position 2 months before they fired her. She's actually in court now!

If he lied on his application, and he probably did if they fired him, then yes it is legal. If he did disclose his criminal history, he should be safe unless he missed time or broke some other rule they have. He has to check out his employee handbook.
