Hi Fluffy,
Please accept my condolences for your tragic loss.
Nothing can be done until sentence is passed. The CPS must then appeal against sentence as being too lienient if this happens.
I hope you get a reasonably satisfactory outcome.
Good luck

You have no right of appeal. The Prosecution can appeal on rare occasions where it seems that there has been a miscarriage of justice, but this is a matter for them and you shouldn't get involved. What you can do is bring a civil action in damages. It is of little comfort to receive monetary compensation when you would so much rather have your brother well and alive, but if this man is in good employment and at liberty, he will be in a better position to pay compensation to the family.

I'm pretty sure you can't appeal, only the criminal can appeal his sentence (just another case of the criminal having more rights than victims in this country -- disgusting). You can sue him in civil court, if only to make his life more miserable. You should also have the opportunity to plead before the court for a stiffer penalty -- they usually let family members do that in murder cases.
Other options would be to embarrass the court into doling out a more reasonable penalty. Call the local TV station and newspapers to make them aware of this injustice. Call people like Glenn Beck, Sean Hannity, et al... they love to nail judges when they are being too lenient. Write letters to judges, Congressmen, Senators, newspapers, state prosecuters, etc to try and get someone to step in and make this right.
Sorry for your loss and good luck nailing the loser.

If you are talking about his criminal case the only appeal is by the State. I recommend you contact the prosecutor and ask if you can give a victim impact statement. You can also urge him to appeal but the decision is not yours.

I think you should just be glad if you get a guilty verdict for the culprit.
