in most cases, if the father has a court order to pay child support, before trying to get joint custody, he has to keep paying up until the Judge grants joint custody or not. After that, it up to the attorneys,(yours&his), you and him how the support is paid or not paid. For there is a possibility that if joint custody is granted, one of 2 things can happen, 1: you both pay child support while child is with the other parent, 2: neither one pays support,(unless there is back support due)

I hope you don't live in NC...if you do, good luck getting joint custody. You still may have to pay child support even if you do get joint custody. In NC, it's considered joint custody as long as both parents have the kids at least 123 overnights. The child support calculator will take into consideration the actual number of overnights with each parent as well as income, child care costs and insurance costs. Plan on paying child support.

Legal joint custody has nothing to do with physical custody. If the parties are splitting parenting time equally, it is still possible for the parent with a higher income to pay support. Support is a calculation based upon both parties income, and is desiged to ensure that the CHILDREN are able to enjoy the same basic household entitlements as when the parties were together.
