My husbands place of work called my phone and threatened and cussed at him on our answering machine. Is there anything saying that owners can't just call employees phones and cuss? Oh and can owners fire you for not coming in on a day that your not scheduled? And can they say you quit because you don't go in on a day your not scheduled?

1st of all DO NOT delete that message! Well, it definately sounds like you have a case of unjust firing. I need more facts though. Like, Did your husband have any other issues at work, or has he been written up? Why was the boss so mad and cussing on the phone? If he threatened your husband, that is assault. Your husband can press criminal charges.

On to the unjust firing. Several states have different laws for this. I would ask for severance pay as well as report the comapny to several places such as the Better Business Bureau and the Employment Commission. Also got to your local law clerk and file a civil suit if you really feel that it was unjust. The Clerk probably will also have other resources on who you can contact.

I would personally open the phonebook and call a few law offices & find a place that will give you a free consultation. Many Lawyers will do this.

You could also call the ACLU (american civil liberties Union) and explain to them the situatiion and se if they can help. Also your Hubby should right away file for unemployment benefits because they do take a few weeks to begin.

There are no laws against verbally abusing employees, but if it can be documented with specific dates and circumstances, it will provide good evidence if your husband decides to quit and needs to file for unemployment. Save the recording from your answering machine to make your case at the unemployment office. Quitting because the work environment is intolerable due to stress and the verbal abuse could be considered an acceptable reason for quitting and make him eligible for unemployment.

As for not working on a scheduled day, sounds like there was miscommunication somewhere. Was it posted and your husband just didn't see it? Posting in common areas is considered notice, even if your husband was not specifically told he had to work. They could have grounds to fire him if that's the case.

It is my opnion that if my work needs me I go. Weekends and overnight too. 3:AM ? Im on my way. Christmas Day ? Ok
I have not been yelled at without first making a big mistake although I think his reaction was overboard and exagerated. I wont make that mistake again and Im more carefull about other tasks

touch the exertions board and likewise the EEOC ( equivalent Employment threat value) on your section. Discrimination is a similar wether there are 2 workers or 2 hundred. good success!

No they may not do all of that. What you are experiencing is work-place harrassment. You can take action, since you have proof and make a police report. They are acting very unprofessionally, and i don;t thin you or your husband should take any more of it. You should take action to stop this harassment.
