Being married you have 2 options.
1. File married.
2. File married but separate. You will need his SSN to file, but that is for reference purposes for the IRS.
In general if you file Married but separate then you will pay more in taxes. However, if your spouse does shady business then in order to protect yourself you might want to file separate and pay more taxes. (Healthier for you in the long run.) Your CPA or tax office will be able to run the numbers both ways. It is true that if one itemizes the other must as well.
To Miss Catherine below me: I hope you never get audited. I've seen it done to people who do what you and your husband do. It isn't pretty and the penalties are incredible. It is illegal in case you didn't know.

You might want to figure it both ways. You are usually better filing joint taxes, but if your partner has some serious financial issue's you might want to do it seperately.
Either way, being married you will pay more than the single people it seems.
Go to a CPA or HR BLOCK and have them figure it out both ways.

No, but I would consult a tax professional - I thought about this last year and I would have been slammed with taxes and would have ended up owing...not worth it.

You can always file married but filing seperately. But for bigger refunds, you would want to file together.

No--you can file Married but Separate. But if one person itemizes, you both have to itemize. I'd suggest doing it both ways to see what will give you the biggest refund.

My husband and I have both checked "single" every year we've been married and nobody's seemed to care to gosh awful much.
