if it's a reddish-brownish color, it's rust spots.
if it's more like a "wet looking" spot, like when you drop grease on your shirt then either you're dropping greasy food on you and not realizing it, (remember, even cookies are greasy), or it's the fabric softener not dissolving right in the wash. If you have a newer washing machine, use the little dispenser that regulates when the fabric softener is going into the wash, if you manually do it, wait until the water is almost filled and add the softener then. Sometimes when you add the softener into the wash, directly onto the clothes, it'll stain or leave a greasy residue.

I work in the fast food industry and have found that the big containers of the orange hand cleaner that you can get from Costco (Can get smaller ones from other stores) will help get set in grease stains out of shirts, but you have to put through an extra rinse.

I have noticed that sometimes the liquid fabric softener will cause these spots. They will wash out, but it is annoying. Try using 1/4 of vinegar in the last rinse cycle of the wash instead of the fabric softener. It does not make your clothes smell like vinegar. Use a dryer sheet to help soften the clothes

If you are putting them thru the dryer that is setting the stain so that may be why some of them don't come out. If you have a local drycleaner that you trust talk to her(or him) they may have some idea what is causing the stains, sometimes the products you use will cause them(deodorant/cologne,excessive body oils, etc..).
