When I started with my company 18 months ago, they added language in the offer letter that said I would pay back all relocation costs (approx. $18k) if I left before July 2008. I may have signed it, but I'm not sure, but it was in the offer letter that I accepted. This place is dying and I want to get out of here. Can they actually sue me for this money if I leave whether I signed or not?

They absolutely can. If you feel the compay is going under, you should talk to your boss and see if you can mutually agree to end your contract.

Depending on the wording, they could take the money back even if they fire you. Usually, they have to fire you with cause, which most companies won't do because you can sue them. If the company is going under, maybe you'll get laid off. You need to find out what the terms are.

Seeing that it's tax season, why don't you say you need that letter to give to your auditor, if you don't have a copy of what it says. Thoroughly review it, and make your decision based on that.

Also, if the company isn't doing well, they are going to be more apt to sue you because they are looking for money.

On the other hand, if you have some real marketable skills, you may be able to get another company to fight or reimburse you that money.

Ask for the letter.
If you did accept it yes they can sue you.
If you didn't sign the letter they can't touch you.
However, if the place is going downhill they may just let you go as a cost cutting measure.

Best ask a lawyer in the area who understands the laws in your area about companies.

If you signed it, or accepted the offer outlined in the letter, then you have agreed to a contractual and binding agreement. So, yes, they can most definitely make you repay the money.

If you signed the document, then yes, they can legally come after you for the money.

If you break the contract, yes they can. If they fire you no.
