Who do I call?
I had a free year trial of 365.com radio player last year & I tryed to get it to work, with no luck, cause I'm on a slow dial up connection. The music plays for about 20 sec. then a long pause of nothing, I wrote them & asked for help, but no reply. This thing was to play continueous music & would not. Now after never being able to use the servise for the year, I get e-mails from them, saying my contract is up for renewal & they had made attempts to charge my paypal account for another years service with out my consent. I have wrote them 2 times now asking them to close it, but the continue to make attempts to charge me for another year. Who can I report these actions to? & if they charge me, can I sue them for doing this? 365.com is attempting to rip me off!

They're not trying to rip you off. First off, you should read the terms of service and the system requirements. Most streaming content sites don't work with dialup and this is clearly stated.

Charging your PayPal or credit card automatically is standard practice on subscription based products. You need to go to their site and cancel your subscription. Follow the instructions on the site to cancel your subscription. Sending e-mails or snail mail won't help unless you've already run through the cancellation process.

No. You can't sue them. You are in a binding contract that says after the first year they get paid for you using their free service. Sending emails are not going to fix the situation. You need to contact 365.com, under "contact us" or in the search on their site put in "Contact Customer Service". You need to explain to them you were on a dial up system and their information was misleading and did not work. In your post though you say you were able to use the service, did you switch to DSL anytime? Did you read the TOS(Terms of service)? Just because it says "free year" doesn't mean that its truely free. The internet is the biggest way to be scammed. It happens almost every 3 minutes.

Advise PAYPAL. Talk with a State representative, they can help you lodge complaints and even help with assistance. See if the State rep can refer you on to a Federal rep for help as well.
Report the company to Better Business Bureau.
Make sure that you advise any bureau that can affect you credit rating. If its a scam, they will not bother, but if its a legit company that is just doing the dirty, go on the offensive as much as possible. Document all the actions you have taken, including how the service never worked. If it comes to court, then they will want you to prove you did all possible things to resolve this and that the companys behaviour was the fault.
Its a pain, but it will pay off if the company decides to be totally patoots.
