in a civil case what can i expect...my ex husban is saying i talk negatively around the kids about him...this is the second time...last time i got counseling as a charge but he is turning things around again he is very verbually abusive to the kids...i think he recoredeed one of our conversations when my son called telling me what his dad was doing to him, we have joint cusody... but im so nervous what can i do??

Look recorded conversations will not be allowed by any court, by law they are considered inadmissable unless you were aware of it. Look this is a case of you said he said. When you go to court just tell the truth about everything. You should have an attorney representing you. One word of advice if you don't have one find one and lots of times they will work out some payment plan with you to pay for their professional services. Never and I mean never go into these types of courts without legal representation. If you do you are asking for failure.

This seems to come up a lot during child custody hearings. If he did record you saying something negative, it could come back to haunt you, so to speak. I would say your best bet is to apologize for anything you might have said that may have been considered negative. This is not accepting blame or guilt, but merely acknowledging that you might have offended your ex unintentionally. This action covers anything you may have blurted out in anger, or that might have been recorded and misconstrued..

Stop fighting each other.It will do untold damage to the children to see you at each others throats all the time and trying to score points off each other through them! You both had the children and are therefore jointly responsible for their well-being. Consider what is best for them and put your petty differences aside.

Information gathered by using an undisclosed wire tap is inadmissible in court. That does not mean people can't do it, and use what was said to entrap.
