Really sounds like a Police State, or 1984! Is that all she's got to complain about? I can't believe that people can be that intolerant, or that the council wouldn't just chuck the letter in the bin. What on earth has happened to common sense in this country?
I suppose maybe we don't know the full story - there's often something else going on in these stories. Maybe there's been other things over the years, and they've been driving each other nuts, so there's a bit of a vendetta going on; maybe the back doors are really close together & he's out there every half hour & filling her kitchen with the smell of Capstan Untipped. We don't know. Funny he can't smoke in his own house - maybe his partner objects too. Easier all round if he gave up! But it does sound like a ridiculous over-reaction from the council.

Where has common sense gone. The council employee who made the decision to write to this person should be sacked as should policemen who arrest old ladies for protecting themselves and teachers who will not comfort crying children. In case the cuddle is seen as inappropriate (although I do feel sorry for them as they are in a very difficult situation) In the old days people looked out for each other old people were seen as respected members of the community not potential victims. Children were able to play out knowing someone will wipe there eyes if they cried or clip their ear if the misbehaved . If I were the person who received the letter I would send a reciprocal complaint saying that every time my neighbour started their car the carbon monoxide from it was causing me a problem and see if that warranted a letter.
whatever happen to this apparently free country its going mad

Just heard this on the radio!
This is PC gone mad, the council in question should have a right rollicking for wasting tax payers money to even think of investigating this!
Maybe the tenant who complained does not get trouble with yobs and the like and feels he is missing out on something, who knows?
The complainant needs investigating if you ask me!

They have to share a small space and the fact that none of the participants in the case own their properties outright, or does the letter writer? means that eviction is something the council, being landlord can do, of course it is silly he was only having a ciggarette which doesn't take too long, I say they can always close the windows, its not exactly florida weather out.

can I just add something to this? I am a non smoker in a house with my two children, the older one severely asthmatic. Both my neighbours smoke, one in particular has been very ill himself with bronchial problems and admits the doctors have told him he is damaging his health irrevocably.
My house interior smells heavily of cigarette smoke despite the fact I do not smoke and when people visit I have to ask them not to for the sake of my son.
While I agree this case mentioned here about the neighbour being told he can't smoke outside is a bit silly, if the inside of his neighbours home smells the way mine does at times then I have to say I sympathise with them.
I have not complained about the cigarette smell in my home, I have instead decided to try and move out.

I think this has way over-stepped the line of decency. I am really disappointed that the council even bothered to follow this up. This is ridiculous. So if this poor soul can't smoke in pubs (from the summer onwards) or any other public place, can he/she not smoke in his/her own property that she pays for? That is just so out of order, I'm absolutely outraged that this can happen in a free country. This is what people would do in communism: spy on each other then inform the authority. Is that where we are heading? Outraged to the third degree!!!!!!!!!!!!!!!!

because it cost less to send threatening letters than it does to do council repairs and its easier to threaten Joe Blogs as oposed to evicting the local chavs and troubles makers ... this is the way of Great Britain , makes u proud huh !?!

All the scum bags and pukes of this world get to bother their neighbours with music so loud your house rattles, voices so loud your eardrums pop, swearing so loud you cant let your kids outside, dogs so loud you cant get to sleep, dealing drugs off their door step your frightened to go out for fear of whos out there, abusing each other so much that there are regular ambulances outside, and kids so unruly that your own car isnt safe parked outside your own house!
Yet the council are worried about someone smoking?
Its a joke.

The complainant also claims the smell of the smoke has permeated their lounge room - this isn't acceptable is it ?
If someone chooses not to smoke why should they have to put up with it in their own home/rented accommodation ? The neighbours should ensure they don't put out this guy in any way - much like playing music too loud or letting fireworks off through the letterbox
