is this is admission for embezzlement, can we use this against him, in court of law?

Yes it is embezzelment. Paying it back shows remorse and they may not press charges. If they do, you will probably be arrested. They have to know they are loaning you money for it to be just a loan. Embezzlement is a fancy word for stealing and you know it is illegal so, yes you can go to jail.
