well i got a ticket by a highway patrol man and i requested an informal discovery i sent it 12/15/2006 and i sent copies to the prosecutin(da's) and witness to the prosecution(chp officer) but i havnt recieved anything. I lost my trial by decloration and i requested a trial de novo and its set for feb 8, 2007 but my real qustion is what are the chances of me winning my motion to dismiss as the prosecution and the witness to the prosection were both served with a discovery request (via certified mail) and they did not respond? will the judge most likley grant it or grant continuance and order them to give me my discovery??? thanks and yes it is possible to obtain discovery in a traffic ticket case.

It will come down to were they properly served. I don't think certified mail counts.

you were speeding.....you will lose......they are busy with real criminals..
