taping phone conversations is illegal in some states, ok in others.

It depends on the law in your state. Some states have one-party consent, which means that only person involved in the taping needs to know that it's happening (so you can record a conversation without telling the other person, but someone else can't listen in to your conversation). However, a number of other states have two-party consent, so both parties to the taped conversation need to be made aware. You should look into the individual law in your state to find the answer.

Legally you can tape anyting you want that is not copyrighted. there is no law to prohibit you from making copies of any other persons voice without their express permission at any time. now you can't actually use that recording for any legal purpose do to the fact that you cannot certify the recording. only police are restricted from not being able to make recordings. this does not hold true in most states to the reasonable expectation of privacy. that simply means that if someone is trying to record a private convesation it is a no no. but if you are speaking freely in a public manner or venue than you have no reasonable expectation that someone else can not hear or record what you say and do.

The actual act of taping isn't what's illegal--but using it without their permission or knowledge is illegal.

Also you couldn't use the tape in court if the person were not aware that they were being taped and didn't consent to it.

It's not illegal....per-say.
You can use it to know what conversations are about. But you can't use it in a court of law if illegal activities are going on in your sibling's life.
To make it admissable, you would have to reveal that the conversations are being taped.
The right to privacy act.

Yes it is, the audio part is what's illegal. However, video is not.

probably not illegal but it certainly is imoral,
i would hate to have a family where this could happen
