I was recently sued over something that wasn't my fault. i was served papers for a civil suit against me and I was no way at fault. there was an accident above my home and the plaintiff says my drainpipe caused ice to form? should i file a countersuit for having to go through this aggravation.if so how much$ should i sue for?> the department of highways already told the lady it was not my drain pipe that caused ice it was just cold weather but she paid a lawyer and filed a suit anyway. this person has sued many many people and gotten away with this stuff. what is the best thing for me to do?

oh yeah the ice was 120 feet above my drain pipe and the women hit a pole 250 above my pipe there was no ice at my drain pipe. in the lawsuit it accused me of being irresponsible and neglegent, how stupid can this be.

ok here is what u need to do hire a

1. hire a lawer
2. have him file for a motion to dismiss becase she hase no eveidance
3.if it goes to court u simply call the officer from the department of highways
4. counter sue for all cout cost your atterny, etc. + the money that you would have mad going to work or whatever

You have really one of two choices: Settle out of court or fight her. If you are not responsible, go to court. Try to get someone from the Department of Highways to back up your story. Take pictures, make diagrams, do anything that will help your side. I would not file a counter-suit unless you have a legitimate claim against her (the aggravation of dealing with this is probably not legitimate). If it isn't your fault and you can show that it isn't your fault (dept. of highways testimony), you have nothing to worry about.

File a motion for the dismissal of the case against you and file a counter suit for damages.

have you contacted your insurance agency yet? they will send an agent to your home to evaluate the problem and if its not your fault or the drainpipes fault , be sure they will let the court know.

Get a lawyer and prepare to defend yourself, if you do not defend yourself you will automatically lose and possibly be assigned to pay damages.

if your water ran across her drive wayor even o the road way youcould be liable, same with snow on your side walk you are required to keep it safe
