ok live in TX .i have a 2.5 yr old daughter. i usually claim her. i worked the first half of the year.recently married in october. hubby is gone in Army basic now. how should we file?married filing sep. and me HOH? married filing jointly and him HOH? will we still get eic that way? which is best, as in bigger refund, or what is legally right anyway?where do you suggest going to get it done?

Since you're married, neither of you can file head of household. You can file a joint return, or you and your new husband can each file married filing separately. Joint will almost always save you taxes over filing separately.

If your joint income is eligible for EIC, and you file joint, then you'll get it. If you file separately, you will not be eligible for EIC.

Look for a VITA or TCE site near you - they'll do your taxes at no charge. You can get more info about these programs at irs.gov.
