can i get it taken out?

if a landlord is sueing u can he get it from ur tyax return ,,i am in indiana

Yes, if your landlord has a court judgment, he can attach any assets of yours he can find, including your tax return. Most states give a judgment creditor twenty years to collect the money.

You would be best off to go to your county court house and ask in the office of County attorney. Each State has different statutes.
