Ok I live with my inlaws and we pay them $200 a month, Thats $50 a week, But since December has 5 weeks in it we chose not to give them the extra $50. That would be $250 and it is not worth the $200. So now I was looking for paper to write on and I came acoss a paper from them to us saying we have 30 days to move out or we will be served court papers in a week. This is just something they wrote them selves. They do not know I have it. I am pregnant and they are trying to throw us out. Can they do this? They do not have papers saying we need to pay rent. Can someone please help me who knows what they are talking about?? Also the money is for room AND board, Which I though board was food, which we buy our own. Which there saying we take from them and do not share. PLEASE help.

OK LISTEN WE MADE A AGREMENT OF $200 A MONTH ($50 A WEEK SO ITS EASIER ON US) WHICH WE PAY. THEY ARE JUST PO CAUSE WE DID NOT PAY THEM AN EXTRA $50. WE PAY THEM WHAT WE OWE THEM NO MORE OR NO LESS.

I have to deal with this on my own cause he is at work and they will not talk to to him. But they will talk to me.Also I do help them with things around the house. AND they can not evict me cause I have proof that I live here and it is also my husbands house. I dont care if it is there house, we live here to and we have rights. There are laws.

Well, that is messed up. I'd find out if that is really their intention, since they didn't give you the paper officially yet. If they are trying to get rid of you guys, that is. Also, it's really hard to find a place to rent for less than 250 a month! Are your inlaws strapped for cash? Then I can see how they would want some money....but just booting you out for not paying an extra 50 bucks, geez. How is your relationship with them? Strained? Do they like you? How long have you been living with them for? A long time?

If they are mean and nasty, you could always casually ask them if they are declaring the 'rent' on their tax returns. That is dirty pool, I know, but I'd only do it if they are playing dirty first.

From what I know about renting, it takes 5 months for a landlord to evict a tenant. Tenants have rights, whether they deserve them or not is depending on the situation. If money is tight for you and your buddy, tell them that, and tell them you want to pay the money but it's been really tough financially. Are they sympathetic or not? If they are, maybe they will reconsider.

Also, are you and your boyfriend good 'tenants'? Do you leave the house messed up all the time and have loud parties, or are you considerate and keep everything tidy? Maybe you could help around the house with chores, to keep the rent down. See if you can work out some sort of agreement, if you can talk to them.

If the agreement was $50 a week then you owe them for five weeks, not four. If you miss a payment, they are entitled to start eviction proceedings against you. A handwritten eviction notice, done without the benefit of a lawyer may not be in strict compliance with the law, however, the housing court will probably take into consideration that they are acting pro se (meaning without a lawyer). It does not matter that you are pregnant and it does not matter about the food. If you are not paying the agreed amount and they want you out they can make you leave. It may take a while to go through the court and it sounds like it's going to be pretty uncomfortable in the meantime if you stay there the whole time they are trying to get you out. Why don't you do the right thing and either pay them what you owe them, or agree to leave without a court fight?

This will come to a bad ending. If you are asking for the legal ramifications, here they are:
1) You do not have a legal, written lease.

2) If you were to pay $200.00 per month to them for rent, then it is $200.00 per MONTH rent. It does not matter how many weeks
there are in the month. You would not have legally owed them another $50.00. If you told them you would pay $50.00 per week, then you owed them the extra week.

3) They can write anything they want to, they OWN the house. You do not.

4) You have nothing in writing saying you were paying "room and board". You said in the first sentence you were paying rent.

You do not have any rights there at all. They own the house and you are living there because they allowed you to live there. You "found" a paper that says they are going to ask you to leave. If I were you and your husband I would be looking for a place to move in to before they kick you out.

The other side to this is, your husband should be handling this situation, not you....They are his parents. You should not be involved in this and you are pregnant. Your husband should not be allowing you to experience this type of situation when you are in your condition and emotional state. Send him in to deal with them. You should only be taking care of yourself and that new baby. You don't need this to contend with..........................

It all depends on what state u live in, Some states require the Landlord to take the tenant to eviction court. It doesnt matter what the reasons are for you not paying,,, or any paperwork the landlord has. All the courts will do is give the tenant a time frame like 2-4 weeks to vacate and not pay the back rent. You need to do some research on line as the state of ILL is one that needs court intervention

I am no lawyer but 50 dollars a week i would consider that room and board. Now did you and your husband sign a lease agreement and was there any security deposit and first and last months rent required. If there is no legal bindings eg. renters and landlords agreement they have no legal actions to take against you. The paper that you have found did it have a law office name on it or the name of a lawyer, it would be an legal cover head. and was it notarize. In short they are trying to scare you into giving them the extra 50 dollars but stand your ground and don't give in to them. Laws in some state varies if you live in the northern part of the states during the winter months it is illegal to evicted someone especially one who is with child on the way.

Things like this are always tough when family is involved. If there were no original papers drawn up and signed by a notary or something to that point, they can't really take you to court, but it is their home and they have a right to say who stays and who goes. If I were you, I'd try to find a place somewhere else. This is just a neverending cycle of you say they say. Even if they change their minds this will always be in your mind. You'll be wondering when they will try and make you leave again. With a baby on the way it would be nice to have the extra help, but if you guys aren't on good terms, then it would be best to find a place of your own.Best of luck to you.

Landlord/Tenant laws vary a lot from state to state. You don't say what state you live in. In a lot of states, absent a long-term lease agreement, a landlord can give 30 days notice to a tenant to leave, and the tenant will have to leave. You could always fight it in court, but really...it would be expensive and not worth the trouble. You should just move out after 30 days and make it easier for everyone.

If you entered into a verbal agreement to pay rent, they can give you written notice, no matter how unprofessional it may look for 30 days. The 30 days doesn't have to be for non-payment of rent, it could be for anything. Also, if you stated $50 a week, regardless if you feel it's worth it or not, you owe them the $50 for that 5th week.

If you do not have a written contract, in most states, if not every, they have no case. It would never hold up in court. You could say they were letting you live there for free and you were just being nice and giving them the money. But if I were you I would try to find another place anyway no matter how hard it is, you and your man would be much happier.
