That depends on several things including, but not limited to:
1. Is it civil or criminal?
2. Is it a state or a federal action?
3. What jurisdiction's laws apply and are there conflicts of laws?
4. How was the evidence obtained?

Most law schools spend a semester long course called Evidence, on this very subject. It is also touched on in EVERY OTHER CLASS that a law student takes.

There is a whole book called "the rules of evidence" that lawyers need to use. Can you be more specific about what type of evidence? Is it obtaining records/emails/papers? or is it other types of evidence? Is it a criminal trial or civil trial?

It also is different in different states.

It's called discovery and it varies by state. It really is just a request from a defense attorney to the prosecutor's officer, under discovery, for any evidence that while be used against their client.
