designing a law for my law class that bans abortion except for rape and incest.
I'm making it so that minors can get abortions without parental consent but women over 18 have to follow the law except when they can prove they were raped or were a victims of incest

Pro- alot of women will think twice before having un-protected sex.
Con- Besides all the picketers and riots, there will inevitably be a few women who WERE actually raped or victims of incest who cannot prove it, and be forced to bear the child from that heinous crime.

If you are prolife or an abortionist you can argue both ways. Personally, I would set an age limit, under 18, say 13 to 17, they do not need parental consent, and under 12, then parental consent with a judge ruling. Another point, have a judge giving permission to under 18, so he can find out HOW she got pregnant and talk to the daddy with a probation sentence or just to talk to the girl in private with a female matron present to make sure it was not incest or rape. Point - find out who the father was and also have the judge talk to him. But that is dubious, cuz if the girl is normally under 18, the man could be charged with statutory rape and a judge could not look the other way. Problem with this too.

The con of this law is that 9x out of 10 there is no physical proof of rape. Even with DNA, the accused could just claim that it was consentual. Most of the time, rape goes completely unreported. It is wrong to ban abortion by putting those exclusions on there, even with the best of intentions. I also completely disagree with legalizing abortions without parental consent. If minors think they are mature enough to be having sex, they should be mature enough to tell their parents about what happened. More importantly, girls under the age of 18 are still children (I don't mean that in a demeaning way) and if a girl has gone and gotten herself pregnant, that is the time when she needs her parents the most.

Minors shouldn't be able to get one without parental concent because they aren't going to be able to make the right decision by themselves. Don't get all mad at me yet, let me explain. Minors usually jump into a decision without weighing all their options. For example: They do it so their parents don't find out they had sex. Or they want an abortion because they don't want to get fat. I'm in no way shape or form pro life, but at the same time, I was a teen, and I know that I would not make the right decision without help no matter which option I chose. Parents can be that balance that they need, where they can look at all their options.
Another issue i have with your law is that a ton of rapes can not be proven. Most of the time they are the womens word against the attacker. Making them prove it is like raping them all over again.

More pros than cons... but victims of incest, that part kind of stumped me. Incest is sexual relations within the nuclear family, not necessarily rape so it would be a mutual agreement between the two... family members.. and the women should (My opinion): be forced to have the baby and take care of the mentally retarded child. But other than my opinion, Not a bad idea considering the child WOULD have problems and would be a good candidate for abortion.

if the parents were not with the minor young lady when she was having sex then her choice of abortion is not their business.
the victim has to prove that she is the victim of incest or rape?? sounds like the middle east rape law that makes the woman bring 4 witnesses to her rape to prove it happened....that's not going to work in the U.S.
having a hissy, are you? we don't get pregers by our selves how about some laws for men?

cons:death for the minor,they know that they can get rid of each child they have without parents finding out about it,alot of neglected kids
pros:wont haveto tell your parents if you mess up and live through it

Kids without parental consent already happens - in many, many states.
You can't immunize a child against the flu without a parents consent, but they can get an abortion without parental consent.
