Accept this answer from someone who actually KNOWS! The probability is 12/51 simplified to 4/17.

Yes you are right if he tears up the ace of spades then there are only 12 spades left so if there were 52 cards minus the 1 card that was torn up there 51 whole cards left so your are definitely right 12 out of 51.
