The person residing in the residence has a right to have all locks, alarms, etc changed once it is determined the other person is NO longer living in the residence. This is a safety issue for the person who still resides there. Just as if the person were moving into a new residence and requested or had all locks, etc changed from the previous tenant. This is the same thing. The person who no longer resides there has NO rights to come and go from that residence any longer. I would have had the locks, etc changed the very day they moved out for my own safety and concerns of my property.

Until you get a legal document stating youre allowed, dont do a thing. What you put in your filings is actually hearsay on your part til actually proven such occured in court. He could have been out of town at that time and when he returned home you changed all the locks and codes thus forcing him out for no good reason. This doesnt look good to a judge. Contact your attorney or the courts for advice on how to proceed here without getting into trouble yourself. Good luck

No one can make any changes (drain checking accounts, sell cars, change locks) unless there is an order of the court. If you have to do something before then, you can call your attorney and get a temporary order. Until a judge says so, the other spouse lives there.
