I stayed at a vacation home in Florida. The property management company refuses now to refund my deposit of $300. I want to sue them. I am in Utah and they are in Tampa Florida. Do I have to go through Utah small claims court or through Florida?
Does anyone have any advise?

you'll have to go through Florida's courts, as that is where the incident occurred. call the small claims court and ask them to send you the necessary paperwork

If you want to use small claims court, you have to do it in Florida. However, you can sue them in District Court in Utah and the judgment is enforceable in Florida. Are you going to Florida again? If you are within the next 4 years, you can wait until you're there and sue them. I'll tell you, though, no matter how poor you are, $300 isn't worth the aggravation.

Small claims court, indeed county court, have no jurisdiction out of state -- or in some/many states outside of county.

You gotta sue in Florida.

It depends on your states laws on jurisdiction but normally you have three places in which you are able to bring a suit, a. the county in which you reside, b. the county in which the act occurred (ie the vacation home) c. the county in which the defendant's reside.

you'd go through floridas.

are you gonna fly back?
are you gonna pay for an attorney in florida to show up for you?

either way it will cost you more than the $300....so why fight it? to lose more money?

just report them to the BBB. the company has to make amends to have the complaint removed.

post complaints on them in their guestbook, on vacation sites, blogs, etc. that will do more damage than a little lawsuit ever can.

you would have to go to Florida to file your claim, as that is where the contract took place.
