Not unless you are in IMMEDIATE danger of being killed. If the person said, "I'm going to kill you" but didn't DO anything, and you kill them, you go to PMITA prison.

There are legal ways to aproach this situation. For instance Restraining orders or Charge them with Terroristic Threatening. The Judicial system will always rule in the favor of a less violent aproach.
