Hi , may i ask the natureof your back injury ,how long you were off sick and how long you have been employed by Morrisons? I,m a bit confused as you say that they claim you are not fit but yet have reduced your hours?? As that seems contradictory on their part as you are either fit for work or not. Does your job involve heavy lifting as the factors i,ve listed affect what action you can take. Firstly ,depending on how long you have been there and if over 2 years ,you can ask ,as is your right if your GP has declared you fit ,for an independent medical examination ,paid for by the company -of course this depends on how long you have been there. Secondly ,was your back injury sustained at work? As if it was ,then they will not want you to return ,so to speak as you can take them to industial tribunal and claim industrial injuries if your injury was a direct result of your job /if you did something , i.e. lift a heavy box alone when you were not suppose to ,depending on your contract. Without knowing the exact circumstances it is hard for me to answer in full but briefly ,if your GP/Doctor signed an insurance line declairing you fit , then you are -that is fact and they cannot "overule" that descision - if you are only working the 3hrs a night you may be entitled to help with benefits -again this depends on your circumstances ,i.e. if you have dependents and the amount of wages you are earning ,-ask your local DSS office re this asap .If your back injury is one of which may be prone to you having to take more time off sick then personally i would get a second opinion from an independent doctor for your sake as well as your employers as this can affect your long term employment prospects.I hope some of this is helpful to/for you and all the best.

Have i read this correctly,What the Fook are they on about,they are not and cannot judge if you are fit or not if your doctor says your fit then the LAW says your fit,i think you will find what they have done is a crafty way of making you a part time employee,go and see citizens advice,i have never heard such crap in all my life.

it depends on lots of things what caused your back injury it severity , what your doctor has said have the company sent you for a medical, what are the terms of your contract relating to the hours you work . you need
a, to discuss this with your employer
b, with your doctor
c, your union if you are a member
d, depending on the responses from above possibly the CAB
e, think about the possibility of making a claim if your back injury was someone Else's fault

if doctor says your fit then they are being discriminatory and so you can raise this matter with your line manager initially,if no satisfaction then personell dept will have to give you a legal reason for their decision...try this question on the answers legal site or 2mrw chat to local citizens advise bureau

if the back problem was caused at work than your employee is responsible to make up the difference in wages, if not you will have to seek some form of social assistance. hope you get better soon

GET ATTORNEY
1. file workers comp claim (if work related) entitiled to loss income due to lowered hours since injured
2. file for state disability / social security for reduced hours
3. call unemployment to see if entitled to EDD for reduced hours
