i had a dept with a company then i recived a letter from a dept collections company asking for payment, i didnt recive any corespondence from the company i owed the money to telling me it had been referd to a dept collections company. IS THIS LEGAL? the company i awed the money to still gave me the option to pay off what i owed them with no mention of a referal to any dept coloection company, so i paid what i qwed direct to the company i owed it to. now the dept colection company is telling me i owe them £10 in administration charges CAN TEY DO THIS? shorly if it had been referd to this dept collection company the company i originaly owed the money to should have withdrawn all meens of paying them direct, and informed me that any money owing was to be paid to the colloection company and not them. wher do i stand on this. will i end up paying the dept collection company ther £10 admin fee or is it between the company i owed and the dept collection company to sort out among themselves

ok it was ebay. i owed them £46.98 in seller fees whitch they emaild me telling me and finaly put my account on suspension, but no mention of any referals of dept. I then got the letter from INTRUM JUSTICA telling me they working on behalf of ebay international AG to collect my seller fees of (get this) £56.98 and not the original £46.98 anyway ther was always the option in my ebay to make a one time payment through paypal to pay my fees, ebay never updated that to £59.98 to get the extra £10 so i payed ebay using my paypal account i payed the £46.98 ebay asked for. i recived a letter today from INTRUM JUSTIA saying i had faild to pay the £58.98 ebay seller fees and said a colector would visit my home in the next two days. so i rang them to tell them i had payed but befor i could they asked me if i was ringing to pay my £10 administration fee. i wanted to know what they was on about and got very angry and told them i wasnt paying them a penny i had payed ebay what i owed

first, get written documentation that this debt has been paid. then contact the debt collection company and advise them that the debt has been paid and to stop contacting you. in the US, there are laws protecting citizens from aggressive tactics and the debt collection companies cannot contact you again, once you have requested not to do so

I had exactly the same situation. But first, its a Debt, not a dept. Was your company Britannia music and film, and the debt collection agency Wescot by any chance?

Ok, read the question completely, and i didnt have the exact same situation but a similar one. Anyway, what i'd do is get into contact with the company (not the debt collection co) and ask them whats going on, why you are being charged this money when you paid it off before they sent it on to the Debt collection agency. See what they say, if you trust me enough, email me their reponse at martianman75@hotmail.com with an appropriate title because itll be in my junk mail folder.

I do not know about the laws in your country but in the USA, if you pay your debt to the company you incurred the debt with, you do not owe the collection agency anything.

A collection agency here only gets paid IF they collect from the debtor. If you pay the company directly, bypassing the agency, they get nothing.

Also, here, the company does not have to notify you that a debt is being turned over to a collection agency.

You might want to check with a lawyer in your country to see if your laws are the same.

it sounds like they sold the debt unfortunately very legal

but don't worry go to citizens advise and they could red use your pay back plan down to as little as £1 a week or even a month
i know this as much the same happened to me and i managed to get it reduced down to this much

as long as your rent gas and electric are payed really speaking no one else can touch you

and if you end up black listed so what lol
the black list only lasts 5 years and if you move and not got on the electrical register for two years they stop looking for you
after 5 years the debt is wiped of unless it's a bank

after all your talking civil law

No, you don't have to pay the debt collector anything. You paid the company you owed money to and that's the end of it. The debt collector will continue to hound you, and when they do, make a recording (tell them you are recording of course), explain your situation and that if they continue to harass you, they will be reported to the powers that be.

I find it a bit difficult to pick out exactly what happened but I think the short answer is that they can do what they did, particularly the £10. In many ways you got off quite lightly many people [particularly those who ignored things] ended up paying much more...

companies are using these debt collection firms solely as a threat and it does scare people! it acts exactly as they want it to and i feel the government should interfere and put a stop to these threatening bullies>>in the mean time tell them to get lost they have no powers to push you door through so if you have settled your debt just remind the firm to call off their bullies or you are free to take action against them

companies can sell their debt to collection agencies it is legal. once that is done they can ask once for the money when they tell you it is being done. after that debt collectors can charge anything they want within reason eg admin, visits and letters sorry

Yes it is legal and yes you do owe the £10 admin fee. You can try arguing your case but I don't think you will get far.
