I want to move somewhere else with my three children. Right now the children live with me and I want that to continue. Is it legal for me to move out of State with them when there father and I have joint custody? The arangement we have is he has to give me 24 hours notice before he keeps them and that never really happens because he never sees them. He lives with his mother and she keeps the kids some weekends and their dad is there half the time but does not take an active role in their lives.

Each state is different with regards to Custody laws. There is one consistency that you can not take the children outside state lines with out consent. Since you have an aggreement usually you would need to amend the aggrement. I hope this helps you!!

It all depends on the specifics of the custody file. Once the living arrangement is not specified in any court document then you can move your children anywhere. I think though that the best thing to do is inform him through your lawyer of your intention to move. If he does have a problem then at least it can be sorted out early on.

He will then have to make his arrangement to visit them wherever you are.

Once you can prove that the move will in no way be negative for the children.
