My kids father is in prison. He tried to kill me and thank god he didn't suceed. But, hes been in jail for going on 9 years and i have not had any support from him or anyone. I am im finacial danger no and need help with my kids. How can i get support from him? I have talked to several people and they say I cant get it. That cant be true. He girlfriend now keeps buying them things they dont need, like pocket knives, what is wrong with her? I told her if she wants to get them stuff get them stuff they need, shoes, clothes, school supplies. What should I do? About to have a nervous break down.

I never said the girlfriend was responsible for my kids, i said she keeps buying them crap. and yes he does work in jail and has money saved before he went to jail. I dont need sarcastic remarks i need advice.

As a matter of fact you can get child support. He is not off the hook. You need to get in touch with social services and the court system in your jurisdiction. In some cases I have heard of the gov't paying child support on his behalf, but when he gets out he has to not only pay the gov't back but also would have to continue paying child support if your kids are still minors. Don't be discouraged, you need to make phone calls, money dont come easy as you may already know but it most certainly wont come just doing nothing about it either, you know what I mean? Make phone calls, if social services doesn't know they should direct you to people who would know. Mean while social services can help you out trying to figure out ways to hlep you financially. First I'm sorry for all the cr*p you're getting from some of the people here. They should be ashamed of themselves.
You're going to need a lawyer, a woman center might be able to help you get one free, or at a reduced cost.
You didn't say if you had court ordered child support or not. Without a court order you can't go after anything, so if you don't have one you'll need to get one first. I'm assuming you have one already.
Then you should be able to go after his saving, does he own a house, car, any other assets? You should be able to get them too. But, that will take a court order. Also most states will help you collect child support, a few phone calls to the state agency might help get the ball rolling.

Although, he is in prison ; he can still be taken to court. Talk with an attorney. If you get a judgement from a judge then his "counselor" or whomever is designated in charge of his individual case at the prison can get the money from his earnings and pay them toward the judgement.
Keep in mind however, that while many inmates hide their funds prior to prison, they usually don't have access to it while they are residing in prison. Their only income comes from the prison which is usually only cents a day.
Be more specific with his girlfriend. Tell her that they need size such and such in a winter coat, socks, pencils and paper, crayones etc...
More specifically tell him and he can tell her what to get.
The best bet is to forget about him completely. Don't allow someone who is doing time for attempted murder to have anything to do with you and your kids. If things are this desperate then you need to seek public assistance.
Get rid of the internet and that will put monthly money in your pocket for school supplies.

It is a fact of life. Prison = No Money. Now when he gets out and gets a job he will have a bill for all the back child support. You sound the the one to marry a "bad boy" and you do not certainly have any education, cuz you knew it all at the time. And now your kids are paying for it.

No the government will not pay his baby help. in case you have a judgment of help then at the same time as he's in detention center they're going to set it at your state minimum and which would be extra to the quantity he owes in back help.

The most inmates are able to make in prison is usually around 30c per hour and jobs are not plentiful.
What exactly do you think he's going to pay you with?

You can't get child support from someone in prison. He doesn't work, therefore he has no income. When he gets out and gets a job, you can file to get help from him.

He is not working, so what money do you think you can get from someone who is not working? You have no rights to the girlfriends funds, and shouldn't expect anything from her at all. Cut off contact and see about financial aid. by allowing this nut into your child's lives you are creating your own trouble.
