I have custody of my son he just turned 18. The judge signed a stop payment on child support do i still have to pay? whenever i had being paying prior to the judge stopping payment each time i would get layed of work and the state would say i hadn't paid anything is this legal?even though i was sending the payments to topeka,ks.

Not sure I understand your question. Why were you paying anyhow, if you had custody? Did custody recently switch over? Assuming this is true, Child Support usually stops at age 18 unless there is an arrears. You need to make sure the state has a copy of the recent Order.

I feel that you need legal help since your issue seems a bit complicated. There should be free legal help services available for low income parents. You may want to inquire about these at the city or county, or at a court. Otherwise, you may get a free first counseling with some lawyers, you may want to inquire about this by phone, with your first two questions at hand, to see if you have a case.

Good luck to get your needs met, and peace. Bureaucracy is not always logical.

the problem is you are not sure WHEN to stop paying...is that it? if so, i would keep paying until i recieved a notice from the court.

i would also call the caseworker and ask when that court order will be in effect and when i would recieve my copy.

if there are arrears, you do have to keep paying...until its gone.

if you are still not sure what to do, contact your local Legal Aid Office. they are in every state and most counties. they go on a sliding scale so its free to most. look in the phone book, call the county court clerks office or your states Bar Assoc for it.

Your best bet is to be to seek legal counsel. HOWEVER, although the child is 18, you may not be required to pay child support but you may be ordered to apy a portion of his college tuition (if applicable) until he is 23.
