I am resigning today and if my employeer tell me to leave today even if I gave my 2 wks notice, do they have to pay me for the 2 wks. I offered to stay? Is this by law, if so do you have a reference?

No, the company does not have to pay you. They don't even have to have a reason to terminate your employment. If they asked you to leave right away you were fired. When fired you can not collect unemployment unless you became unemployed thru no fault of your own (ie..you were not fired for constant tardiness to work, surfing the 'net instead of working, etc).

Basically they are saying, "We're okay with you not giving any notice. Go ahead and make today your last day." They do NOT have to pay you. In an at-will state (most states), an employer can terminate employment at any time for any or no reason at all.

Once they terminate your employment, they no longer have to pay you. They clearly let you know today was your last day of employment with them. So, no more pay.

If they tell you that you don't have to work those two weeks then get it on paper cause next thing you know they are going to say you quit and you won't get unemployment. Its all about having things written on paper in the world of business.

It really depends on the state. In actuality, they fired you. So you should be able to get unemployment for those two weeks. Further, if you found another job, you might want to notify them that you are now available immediately.

They don't have to pay you for the 2 weeks but if you have any vacation time or sick time you need to look in the policies to see what you would get paid for. Because you earned that time and it is yours and you get paid for it.
