I am having problems in my marriage, can my husband kick me out of my place of resident, when I pay for the mortagage too. I left and I came back.

I am studying to be a lawyer and can tell you with some certainty he can not in fact kick you out if you where paying the mortgage. If he kicks you out you need to call the cops and report him. Take him to court and bring your proof that you have been paying on it, and the reason that you where gone. Without an eviction notice though he has no right to kick you out.

Whomever physically owns the property is the one who decides whom can actually reside in the dwelling.

Now that being said you are paying the mortgage makes it sound to me like you have more claim to it than he does.

So, tomorrow when comes back home from work or the bar or his girlfriends house, let him find all his stuff neatly packed out on the curb.

Usually, if your name is on the lease or mortgage he cannot. Depending on your state, if you've been gone for too long (that would have to be for a while), he can protest that you abandoned him and then maybe he can keep you out of the house. On the flip side, if he refuses to let yuo in, the he is abandoning you and you can divorce and get spousal support if he can pay. Talk to a lawyer to be sure.

No, he can't. What? Is he gonna physically pick you up and put you on the porch and lock the door? If so, call the cops and he'll be arrested for domestic battery and you'll get the place all to yourself. It's your house too.
