It isn't necessarily unDemocratic. Look at the legalization of homosexual marriage in Mass & NJ. All it took was an oligarchy of 4 people in dresses to determing that, magico presto!, a right for same sex marriage suddenly existed.

Since these rulings were supported by liberals, it was very Democratic, however much such an authoritarian decree violates every principle of the Constitution and the principles this country was founded upon.

There was an old joke that in the Soviet Union, a ruling elite that ran the Government ran all the Industries, while in the US it was completely the opposite as it was the ruling elite that ran all the Industries, that was running the Government.

It is not so much a joke anymore.
