Tinker was suspended from school for wearing a black armband that protested the US' involvement in Viet Nam...he was told it was unpatriotic and that it violated school dress code...he and his parents sued the school board under the 1st Amendment (freedom of speech)...eventually after going to the Supreme Court they ruled that "symbolic speech" is protected by the Constitution and that as long as his protest did not disturb school proceedings he had to be allowed to wear it...
