if its from PHones4U I dont think you can be certain that the phone you got was fixed or new.. Ive herd many tales about Phones4U and Carphone warehouse and whether they do any fixing of faulty phones.
Id write a letter to them point out the number of times they have failed to supply goods of merchantable quality. suggest that they cancel the contract unless they can supply a brand new fully functional phone. Insist that they do not break the seal on any box unless its in front of you, check the seal is from the manufacturer not their own "repair" organisation.
point out to them their obligations under the sale of goods act
if they refuse or play silly beggars then take em to small claims court. advice the netwrok supplier of why the contract is being voided. In any event id threaten them with small claimns for providing a crappy service for the alst 4 months... demand that you should egt aprt or all of the cash back caused by their failure to provide you with the phone they offered.
be realisitc the problem isnt with Orange, there network isnt the issue.. the issue is Phones4U and their failure to supply a working handset

I got a v3i on the orange raccoon 35 tarriff from phones 4 u and haven't had a problem at all, I think you could cancel under the terms that it has failed to perform as the contract states, but it's phones 4 u at fault, not orange so there may be a cancellation charge for that.

Unfortunately, Phones4U are not responsible for the phone itself.
Any phone sold on contract from any retailer is sold with a 12 months manufacturers warranty, this means that should you encounter any problems with your phone that its the manufacturers problem and not the retailer.
When you take your phone back to Phones4U they simply send the handset back to the manufacturer to sort it out.
You can bypass this by contacting the manufacturer yourself - Samsung offer a courier service and will will your phone up, fix or replace it and then return it to your door.

If you have orange care insurance on the phone speak to orange and explain to them whats wrong with your phone, they will help you, you dont have to go thru the original retailer the network will help you too as its their phone you are using, If you cancel your contract during the minimum term orange will charge you for the remainder of your contract which could cost you hundreds of pounds.

maybe try dealing with orange direct. i got a phone on 3 from phones4u. that messed up after a couple of months so i phoned 3. they repaired it. a month later it broke again. this time they upgraded it. no probs since. its worth a try.

play your face as much as you can shout in the shop tell papers the lot then sit back and watch the freebies roll in.
they will do there best to avoid bad press especially as a new owner has just took phones4u over

defintly they have not provided the service or the equipment that you sighed up 4 you have a strong case get rid of it you dont need all that earache of a mobile phone and phones 4 u staff r terrible you r spot on no help what so everthey havent got a clue

They can cancel the contract altogther, if they say they cant its all BS!you had the phone returned 4 times now so tell them your not happy with the service etc and want it refunded!

bring the phone to the shop where you got it, and tell them to cancel all further transactions. if they get sniffy tell them you'll go to OFCOM. phones for you are pretty bad, i nearly got swindled because of them. free insurance with a contact phone i got a phonecall a few months later claiming to be phones for you wanting to upgrade my free insurance but they needed my bank account details!! yeah right. in fact i would just go to OFCOM now.

Complain directly to Orange customer service and Samsung UK, also tell 'Phones Fcuk u' why you are considering writing to WATCHDOG, after your recent poor service on their behalf
