I am astonished at how so many Bush defenders are willing to surrender privacy and habeas corpus to this administration.
What have we become?

Ed: Habeas corpus is suspended by the MCA of 10/17/06. We can no longer challenge detention if the president classifies an American citizen as a terrorism suspect. -

Humanity: Legal and Constitutional are different things entirely. We can stand in opposition to bad laws. Also, all those American Japanese who were unconstitutionally interned were given apologies and some... monetary compensation and repairation. This is still an abuse of power.

M1A1: No. Anyone ACCUSED of being a terrorist deserves habeas corpus protection. As this law is written, ANYBODY can be rounded up, arrested, and made to disappear. Even you.

We have become a police state. I dont understand the need for a military commissions act, Why? Because this is america, Pre 9-11, we were still the greatest army in the world. We had military procedures for POW's , and we had the FISA court to allow almost instantaneous NSA wiretapping. . The john warner defense actand the millitary commissions act, make it easier for ANY president, current and future, to abuse this law with literally no oversight from congress. See, theres nothing wrong with detaining terrorists and bringing them to trial. hell, put them to death. hiding whats going on is. if youre got 400 people, that havent been charged with terrorism in 3 years, then weres all our money going? what was the point of passing the law if youre not trying anybody. ? obviously a hidden intention

Article One, Section 9 of the U.S. Constitution specifies that a Writ of Habeas Corpus is a "privilege" and that it "shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it."
Although I agree that the decision to deny a Writ of Habeas Corpus to certain persons has been abused many times throughout U.S. history, it IS legal to do so....the legal theory being that 9/11 was an "invasion" and that terrorists and terrorist suspects are the "invaders."
Thousands of American citizens during WWII were jailed without a Writ of Habeas Corpus.
Your statement that "Legal and Constitutional are different things entirely" is not accurate. The U.S. Constitution is the SOLE arbiter of ALL legal "things" in the United States...from a jay-walking citation to capital punishment.
An apology does not negate the fact that something was done legally (constitutionally.) We'd be in a worse world of hurt if we decided on all legal matters by how we "feel" about it.

So far all you seem to have to back up your claim is that anybody caught fighting for the enemy deserves habeus corpus. The fact of the matter is that during the entire course of our history this has not been the case.
I suggest that you take the political blinders off and look at the whole picture.

It amazes me some Americans are so stupid! Our government is taking away our rights, little by little. Americans should strongly oppose any changes to the constitution that limits the "rights" of Americans in any way - no matter your opinion on that particular issue ie: abortion, gay marriage! Now that our government is taking away our liberties without any fight it's hard to tell what they will do next "for our own good" In the 1860's the government added the 14th Amendment (birthright citizenship) that afftced only one group of perople and look how that is being used against us....in my mind the constitution is for "basic rights" for all Americans not situations that affect one group of people.....
Repeal the 14th Amendment

I am very concerned about the way the Bush administration has worked it's way around the constitution. This group seems to try to find every way to empower the presidency and cut power to the other branches of government.

Yawn, I'm tired of those that throw that argument around when a policy doesn't suit them but have no problem when their "programs" do the same thing. And they wonder why others aren't upset? Easy, the rhetoric over and over again has numbed the American public into indifference.

I totally agree, I think once we fighted for the very freedoms that we have let go. Our right to protest, our right to freedom of speech, our right to freedom of association, our rights to privacy. Its the New World Order, thats what they all discuss at the global economic forums.. although it is all secret and denied ofcourse.
