we were getting a moving date today and the guy who was buying our house has pulled out of the sale. We have paid out £400 on surverys ect now we are back to square one does anyone know what can be done about this. Can we sue him or not?

If he hasn't signed the contract and the sale hasn't completed, then in England there is nothing you can do. It happens all the time.

No, unless you live in Scotland, I'm really sorry there is no legal contract that has been broken by your buyer - this is a problem that people in England face.
However - don't give up - the fact that you have your purchase property underway puts you in a strong position.
Some buyers don't want to sit around for ages waiting for you to find somewhere and will be glad to find a seller that is ready to go.
Discuss this with your estate agent.
Wish you lots of luck - selling and buying is so stressful. It will all be worth it in the end.

only if you've exchanged contracts. At which point he is liable for 10% of the purchase price of your house.

Happens all the time. we spent thousands on wasted surveys and aborted sales last time we moved. Took 2 years and 7 buyers before we got there.

And i buy, develop adn sell properties so i waste thousands on timewasters every year...

to be honest, £400 is getting off lightly.

dont think theres much you can do unless you have already exchanged contracts, if not then i guess you have lost your buyer and have to find another quick, your solicitor will not be in a position to give you a moving date into your new property (exchange) if you a dependent on the sale of your original property to buy the new.

You did all that without an Earnest Depost how silly you must be. No contract, Get a Realtor, do yourself a favor.

Dont think you can do anything. I think he's entitled to pull out anytime before he sign for it.
