I have cheated on my wife and slept with another man's woman. Unfortunately, I accidentally impregnated this other man's wife and she is now pregnant. I admitted everything to my wife and apologized and she has forgiven me. My wife and I now want this baby to be part of our family. The woman I impregnated doesn't want the baby.

What I want to know is whether this baby is legally mine or does it belong to the woman I impregnated? If it belongs to the woman I impregnated then if I wanted to have this baby would I have to go through adoption? Adoption laws state that I must pay a certain amount of money, so if this baby is already mine then I wouldn't have to adopt and can save money.

No need to feel for me, Celebrate Life. I am very happy to have another baby in my family. The new baby is not a disaster but a miracle, so I am nothing but happy.

You did not mention whether the woman in question has told her husband, just that she doesn’t want the baby.

As soon as the child is born, you should request a DNA test. Just because she says, or believes, you are the father, doesn’t mean you actually are. Women are often mistaken about when they become pregnant.

If the DNA test establishes that you are the father–regardless of whose name is on the birth certificate-- then the child is legally yours as much as hers and you do not have to adopt the child. However, since you say you and your wife want this child, if the mother decides to allow you to have custody of the child--which you say she doesn't want--then your wife could adopt the child–with the mother’s consent.

On the other hand, if the woman allows you to have custody and your wife does not adopt the child, then the biological mother could be required to pay child support. So, you could collect child support from this woman until the child is 18-years-old.

You got ZERO rights till (if) the baby is born. Once the child is born, you can ask her to name you as the father on the birth certificate or ask the court for a paternity test. Once you are established as the father, you can petition the court for custody of your child. However, the mother may change her mind and decide she would like to have custody of your child. Then you would have to fight it out or compromise. You want to be the best person you can because what you do now can have a bearing on who has custody of your child.

Funny isn't? You have no say until the baby is born. That means if she wants to have abortion she can without your consent.
