We don't know where the father is, so having him sign a termination of parental rights is a little hard. He's also not on her birth certificate. Anyone know how we'd be able to do this?

Its usually fairly simple.

You will have to hire an attorney in your area.

Most states require that you've been married for 6 months. Your financially able to care for the child. Sometimes there is a "home study".

Speak with a good lawyer. If the father is not in the picture for a year (in some states) its considered abandonment on his part.

The courts always look at what is in the child's best interest.

Contact a family law attorney. They may be able to give you some info over the phone without charging you anything. Or at least point you in the right direction.

Some counties have FAmily Law Facilitators... they advise folks in family law situations... which this is. Also, child welfare agencies do uncontested adoptions all the time... Contact your local child welfare agency and see if they have a process for handling step-parent adoptions. Here in California, it's a common thing. We do them all the time.

In some states you can print an add in the paper (after you have exhuasted all means to establish contact) and he has a certain amount of days to reply.
If he does not, it is considered abandonment and then they (the courts) can legally terminate his rights

Did you marry your wife before she her daughter or after if it was the latter she would of cheated.

well you could try the internet or a private investigator but thier kinda expensive or the phone book if you know hes in the same country but other than that im outta ideas

you have to have permission from the father too i think?
because he has to sign papers.
and if he says no then you CAN'T!!!
but if he's not on her birth certificate then go for it.
but you definitely need legal advice on this!
