Makes no difference how old the child is. If you were getting aid from the state then he owes the state not you or the child.
As long as there is a balance owed to the state he will have to pay it off just like any other debt. And most states also add on interest to the balance.
Even if the father files for bankrupcy child support is still owed. That is one debt that can NOT be cleared by filing. Even the IRS will hold any returns that the father would normally get and turn them over to the state.
If he was in jail it is still adding up and if he can't afford it after he got out, and had more kids then he should have thought of that before he had the other kids.

I don't know the law of child support in your area. But where I live if the ex owes back support and the kid is over 18 and not in full time school. Then the ex has 10 yrs to pay it off but if it isn't then he doesn't have too. Trying to get support for your child is not a easy thing and the states don't back up with the things they say they will do to the one that doesn't pay! I should know, I have been back and forth on trying to get support for the last 4 yrs. The ex only went to jail for 5 days and that's it! The state keeps letting go. Good luck!

If i understand you correctly you collected money from the state through some type of state funded program and now the state will offset that from any money collected from child support, correct? Because your x was suppose to pay child support and didn't so you were able to qualify based on income for a state funded program but now they want their money through child support if he pays. If he owes the state the money you can't forgive the debt, if he doesn't owe the state the money but owes you directly then you can.

Since your son is now 20 years old YOU wouldn't be able to collect the child support owed anyway. The only person who would have a leg to stand on in order to collect would be your son. It is up to HIM whether HE wants to go after the back support owed, but he'd better do so before he turns 21, because once he hits 21 all child support orders become null and void.

That is your decision if you want to drop the charges and let it go, but your right he would have to pay the state back if he owes them anything. My son was 21 when i started getting support from my ex, I could have dropped it but didn't (but my son was his only child) 8 children that's alot but he should have thought about supporting them before he had them. Don't write off that child support. The fact is that even though your son is now grown he still owes that money to you both. If you feel that you don't need the money, fine...use it to help your son pay for college or start a life of his own. Don't sell yourself short....

You're right, write it off. You've raised your son and now he has seven other children to worry about. You said that he was a good father to your son, then let it be. Stuff happens, give the man a break. I raised my son without one dime of child support. Way to go MOM!!!!!!!!!!

did you collect the child support from the state, that must be repayed. If you did not collect it, and can forgive it, then do so. If he has been providing support in any manner then the courts need to know.

child support should be paid for the child as he is growing up. if you collected money from michigan, he owes the state of michigan. he is not any different than any other man who, for some reason, got in arrears.
