You mean on the street or something? On the street you may not see them as a con artist, but if you are talking to a person [who is supposed to be doing something for you], and they seem like they are way too confident [i.e. i haven't lost a case yet!], then they are probably a con artist. Now if you are talking about a person who is in a relationship with you, you should ask more about their past and ask random questions like: oh! is that restaurant still there?"
For a possible con lawyer:
"How many previous clients did you have?"
"what was your hardest case?"
"how exactly are you going to defend me?"

For a possible con gf/bf:
"what college did you go to?"
"who were your parents?"
"where do you spend your time?"

The best way is study the tricks of con artists caught and are now repentent for their deeds. They will have the best answers. You'll have to do a web search for scams and con artists as the search engine words.

Con artists basically run the same scams over and over. Here in Mississippi, with the aftermath of Katrina, there are lots of home improvement scams going on. I ran a couple of men off last spring trying the old "We got some material left over from a home repair job and can offer you a great deal on the work price." Old old scam. They nearly met my shotgun had they been a little slower in moving out of my yard. I got their tag number and truck description in case they came back while I was gone.

Depends on what kind of con it is. If it's money, you can usually just look at the bill and if you don't see red and blue fibers it's fake. If it's some kind of item that they're selling... Just don't buy it.

They are usually way overconfident of themselves.

Only their input matters, not yours.

They always need to be in total control of the social situation they are involved with.

If they're any good you can't.
