I have a son who wishes to change his surname to the surname of my new husband. I was unwed when I had him and his natural father is unnamed on the Certificate of Birth. My son is 13.

I don't know about the state you live in, but in WA state, children cannot change their names without approval of BOTH birth parents.

actually - having dealt with this myself, all you do is file for a legal name change - NOT a termination of paternity. Your husband does NOT have to adopt him in order for your son to have his last name. You can get his name changed without terminating his biological father's rights to financial support and visitation. It cost (here) $150 filing fee and it was done. It's a paperwork matter, not a courtly one so it should be easy ---- it does depend on your state's laws, though. GOOD LUCK!

I think you would do it the same way you changed yours when you got married

however your new husband may have to legally adopt him for the name change (I know in florida if there is a father on the birthcertificate the father has to give permission for the step father to adopt then the name can change)

You can change it. I changed my daughters by going to the birth/death certificate office. It only cost me $8.00. The laws may vary though were you are.

consult an attorney in your area to find what the law is there and how you can change the name

get a family attorney - fill out the papers, go to court. here in florida
the total cost is about 250.00

Let him. You go to court nd the judge will decide, your new hubby will also have to legally adopt him
