ive just recently moved into my own apartment at the end of october 2006 and every since i moved in i have had nothing but headaches the first day that i moved in the apartment unit that i was told that i was going to be living in they change it to another unit that was a total dump!!!! the carpet was nasty with marks all on it the walls was not painted broken kitchen drawers stove not working properly dishwasher comes out the wall window wouldnt lock mildew and the first month that i was there my bathroom celing started leaking and i just wanted to know can i request another unit immediately and if not can i break my lease without being liable or if all fails could i just go to another apartment and try to move there before i get a bad name from the apartment that im currently at

This is such poor service to u! I have seen many a property show so called model apts. but u get a dump! 1st thing send a certified letter return receipt requested to the apt.manager, keep a copy of this letter. In the letter ask for a transfer to a different unit, make sure u see the exact apt. u would be transfering to, when u see it ask is this a ready apt. if they say yes and it needs things done, request them to be done prior to u transfering, make sure u check it again when they say it is ready. If they will not allow u to transfer call the health dept. on the mildew issue, asap! Also take photos of all do it now, and file a small claims case. I have a feeling u will get to transfer but if not the health dept. should be a good way to get out of this lease. If your stove is a fire hazard in any way call the fire dept. as well! Hope I have helped. Remember take your photos now if u can use a camcorder also, take phots of everything right down to the window lock thats broken. You do not deserve a bad rental history thats why u want to have copies of everything! You dont deserve the bad name they do! They moved you into a apt. not even ready, by law in most states you must have clean carpet in case of germs, allergies from the previous resident etc. a sanitary issue, as well all apts. r to be painted and cleaned, & there should have been a maintenace employee to repair or replace bad items. I feel if you can it really would be best to move, this property is managed real bad!! Good luck, best 4 the New Year! p.s. if they let u out of the lease & I believe they really have no choice, get it all in writing including the fact that your security deposit will be refunded within 30 days of your move and mailed to new address you give them. Get the mgrs. signature and yours and make sure its on the property paper with their heading and dated, get your copy put all your copies in a safe place.

Have you reported these problems to the landlord? If so and they have not been taken care of them insist on moving to a different apartment. Your health is worth more than a lease. Maybe you are allergic to mold/mildew. I would definitely move no matter what.

I think it depends on where you live. however, the mildew, and leaking ceiling would be reason to call in the city and have your lease terminated.
