In NY state we pay child support till 21. But if the child is no longer living w/the custodial parent, does anyone out there know if we can get the x on fraud charges. Collecting child support w/out having child living there? Want to ask before we get heavily indebt again w/ a lawyer

My best advice to you is to contact the attorney general's office for the state of New York. Failing that, many states have legal aid centers which could quickly answer your question for free. Since it could result in a fraud charge, you might also contact the prosecuting attorney's office and ask them.

While I don't agree with it, in some states, if the custodial parent is still providing the majority of the child's moral support, child support can still be collected after the child has left the home.

In many states, if the child is attending college then the custodial parent may still collect support.

Each state has different laws regarding child support and different ways of handling it. My advice above should help.

Wow 21? that's steep out there, but it is fraud that they are still collecting on child support when they are not living there.

Yes, of course it is. She's accepting payments, even though she knows that she is not entitled to them. Unless, of course ... she's sending the money to whom ever is taking care of the said child.
