They were agreed to by Congress November 15, 1777. Before they could go into effect, they had to be ratified. It took some time.

They could not take effect until all of the thirteen colonies had ratified them. Maryland ratified them on March 1, 1781, and was the last colony (or state) to do so.

It took a while to write them and enact them as law of the land. The Declaration of Independance and the actually Constition are 2 very different documents.
