In this day and age its not the money that raises the children.. it seems you have been the sole parental figure in your children's lives. unless you've done something against the children abusive or neglectful or have an imorral lifestyle then you should be able to keep the children together in the family. stability is the main key for children. esspecially during a horrible ordeal as divorce. also get a lawyer. if in canada(ontatrio) legal aid will cover this for you. been there done that... good luck

I do not know the laws but I doubt you would be considered "unfit" because you are a full time student. "Unfit" usually applies to drug use, abuse, etc. However, how do you plan to provide for them with no income. Also, you want custody of his 3 as well. I doubt that will happen. I have never heard of a case where a stepparent was awarded custody of stepchildren over the biological parent.

Courts have a great tendancy to award custody of the kids to the mother unless she is unfit. Unless you have been charged with child or drug/mental abuse, you are just fine. You may not get all 6 but you will get whats yours and child support, the house, and possible spousal support til you get back on your feet. Remember no matter what allegations he accuses you of, he has to have hard evidence proving you as unfit. Even with the above abuses, he will still need either police or medical reports confirming it. You have nothing to worry about here. Good luck

But you ARE working - your job is full time mom. And being a full time student is an incredible example for the kids as well! Does your school have a free legal department that might help you with some answers? Is there a non-profit in your area that deals with custody issues? You may want to contact these folks for some insights to ease your mind and get some answers.

Can you work something out amicably? Why not try to talk calmly about this and explain to him that his work hours are terrible and that you would give him liberal visitation rights? What is increasingly common is shared custody even if the kids live with one of the parents.

I don't think you are unfit just because you are not working. He would need to pay you child support and possibly maintenance. Consult an attorney for assistance.

you can get custody of the kids providing they are all yours. He cannot find you unfit just because you are not working. You were a stay at home mom which was probably easier considering the number of children you have.

You can still win!!! The courts will consider who can give the best quality care..not quanity. So if you can offer better care then he can then chances are you will win. I am a stay at home mom about ready to go back to work fulltime. I have my 4 kids full time. He gets them sunday afternoons and one full weekend a month. Try and work out a visitation schedule that will work and benefit both of you....especially since you both have weird and hectic schedules. Best of luck to you!

You are a woman and you will get them no matter what the circumstances. Judges dont give fathers children unless the mother is on drugs or psycho. Fathers dont have equal rights in custody cases. It isnt fair but thats the qway it is.

its not likely they will find u unfit. and since you have given them the primary care they will probably give you primary custody with him getting visitation. they could give you joint custody which means that you will have them an equal amount of time as he does. they will take his work hours into account on this also. that will go against him getting joint custody unless he can show that he will have adequate care for the children.
good luck on this and don't be afraid to contact an attorney to get their input on this.

if 3 of the children are his in order for you to get custody i would thin you would need to prove some type of abuse, bad living situation things like that or get him to terminate his parental rights....not working does not mean one is unfit
