I do not want people to get the wrong perception of this question. I would never ever ever consider it. I realize for the the most part the rule for stagutory rape is if one of the people are over 18 and the other is under. But what if one is 18 and a day and the other one is 17 1/2, is that still stagutory rape? Or is there a clause if they are close enough in age?

Every state has different ages of consent. So it depends on the state. Some states have an age of consent of 16, like Alabama. Others have it at 18.

I think there is such a clause but I'm sure depends on the country and state/province. In some countries the age of consent is far younger.

It's illegal, even if BOTH are under the age of eighteen. However, it's rarely prosecuted when the two are close in age and/or close to being eighteen, unless an adult (usually one of the parents) really pushes for a charge.

It is only 6 months till this person is of legal age. It is worth the wait as yes, a person could be prosecuted if the parents decided to press charges for sexual misconduct.

first of all it is statutory rape and second of all it depends on what the age of consent is in your state. however i will tell you this if the other person is not the age of consent and the other person just reached it, it does not matter it is statutory rape there is no clause to well he/she is close enough just like drinking or smoking under age.

First, it's statutory. Second, by the letter of the law, a legal minor and a legal adult having sex is statutory rape. Your local laws may vary, but that's pretty much the standard.

technically yes, but no district attorney would waste taxpayers money to ever prosecute you ... and i doubt a judge would rule against you. the "spirit of the law" overrides the "letter of the law" sometimes.... especially given that this sounds completely contentual.
anyway, the tem is "statutory rape"
the parent's don't prosecute - the district attorney would (for the person below).

In Missouri, a person under the age of 21 can legally have sex with anyone 14 years of age or older. A person 21 years old or older can have sex legally with anyone at least seventeen years old.
