It isn't the court that charges an offender, it's the arresting officer, the county/state/federal prosecutor, or the grand jury.

The amount of time during which someone may be charged with a criminal offense varies from state to state. In Virginia, for example, you can be charged with an offense up to one year after the complaint has been filed with the police.

Rather than take the word of a public forum, I'd suggest you contact the prosecutor in your area and ask him/her. That's the only way you can be guaranteed that you're getting the truth.
