i am a filipiana who worked in other country and met a american before i went back here in the philippines im pregnant and now i just want to know if our baby could possibly use his last name or can have american citizenship even our baby will be born here in the philippines and even were not yet married since he is still working on his divorce. thanks a lot!

OK I married a non citizen so I have learned a little about citizenship. You have the right to name your child anything you want with or with any ones consent. You can even give the baby my last name. Naming the child after your American boyfriend does not make him the father. Check the laws in your own country but here the father signs an affidavit to confirm the child's paternity. Now citizenship; Just because your child may or may not be fathered by an American does not offer him or her citizenship. He or she must be born here furthermore if your child is born here and you can't prove paternity or the father does not file papers for you; you and your child can still be deported. To be more clear I want you to understand that if the father steps up and say " This is my child" and the baby is born here. Yes your child is a citizen however you can still be deported. Babies are not tickets to citizenship.

My ex and I are also having a baby and I chose to use my last name for the baby. In the baby name book I was reading it said that if you were married or planning to then you give the baby the guys last name but if you are not together than you use the mothers last name. It's your preference though my ex and I just don't get along anymore we've lost contact (he chose to change his number) I would prefer my son to have my last name.

Okay, you had an affair with a married man while you were in this country, and now he's telling you he's going to leave his wife for you even though you are no longer here?

Don't bother honey. You are old news. No WAY will he let you use his name on this child and don't even think of getting support.

Just give the baby his last name and put it on the birth certificate! And yes, baby will be US citizen!

Yes, you can give your baby his father's last name, however, he will not be an American Citizen if he is born in the Philipines.

he does not have to be there to sign the birth certificate. just call talk to him and make sure it is ok to put his last name and yes the baby will be a us citizen.

technically, yes but it's gonna be a whole long mess with him signing a voulentary agknowledgement of paternaty. at least thats wat my parents did with me when i was almost 17. a lil too late lol. anyways... it souldnt be a problem for the baby to have his last name and i beliva that since he is a citizen your child is automatically a citizen because my father wasnt a citizen but my mother was. good luck, god bless, and congradulations!!!

If he's not there to sign the birth certificate I think your screwed. And you shouldn't lower yourself into being "the other woman" it's tacky!
