It is legal only because no one has tried to do it. I am sure that if it ever becomes a problem, some activist group will provide legal support to someone to take it to court. In this instance, unless the business can show that it is vital to the company's business stature that every employee speak a certain language, then there is a sympathetic judge out there ready to strike it down and award an obscene amount of money in judgement.

It of course depends on whether you work in the public or private sector. One's constitutional right of free speech has varying protections in different arenas. In a private business office, the owner has fairly liberal discretion in what speech he can ban. However in a public or governmental office, such discretion is curtailed. In either setting however, an employer could demand that English be the only language used to converse with the public or other clients and coworkers.

It becomes a safety issue - I would say on your own time talk in Hiroglyphics if you want , but when you are in a workplace and there is even ONE person that speaks English then the rule should be that everybody speaks English.

Because if you communicate in a manner other than the language spoken by that one single person YOU ARE THE ONE THAT IS DISCRIMINATING .. in my opinion.

If the employer can prove it is necessary to carry out normal business, then sure. That's why the military can have weight restrictions and height requirements.

that is called discrimination. there are many equal opportunities laws out their, banning discrimination of all sorts. Athough many employers ask you to speak in english while dealing with people, it is often thought of as a positive to be able to speak a foreign language, for example when dealing with people for whome english is not their first language eg tourists, relitives of people origonally from outwith the country, foreign excange students ect.

Think of it this way...if noone in the workplace spoke a language other than english, how would you deal with a complaint from someone who knew minimal english but spoke fluent arabic?
